RIGHT TO OBTAIN JOBS FOR PERSONS WITH DISABILITIES ACCORDING TO LAW NUMBER 8 OF 2016(Study at PT. Kareb Alam Sejahtera (KAS) Bojonegoro)

Abstract

Discrimination against people with disabilities makes it difficult for them to get jobs. In fact, the rights of people with disabilities to get jobs are regulated in various laws and regulations. Law Number 8 of 2016 concerning Persons with Disabilities also guarantees protection for people with disabilities to get jobs organized by the government or private companies in accordance with Article 53 paragraphs 1 and 2. Article 53 paragraph 2 states, "private companies are required to employ at least 1% of people with disabilities from the total employees". Implementation of Law Number 8 of 2016 Regarding the Fulfillment of Rights for People with Disabilities in Getting Jobs at PT. Kareb Alam Sejahtera Bojonegoro as a private company, has been mostly implemented. Starting from the availability of PT. Kareb Alam Sejahtera in opening job offers for people with disabilities, payment of wages equal to other workers, provision of facilities needed for workers with disabilities, placement of workers with disabilities according to skills/abilities, and not terminating employment due to disability status. However, not all applicants with disabilities can be accepted, because the company has its own company standards and specifications. PT. Kareb Alam Sejahtera Bojonegoro has tried to employ people with disabilities in its company, but the number has not reached at least 1%. Of the total number of existing workers, namely from 3,100 workers, PT. Kareb Alam Sejahtera Bojonegoro should employ at least 31 people with disabilities, while the company has only employed 24 people with disabilities. However, the recruitment of workers with disabilities that has been carried out indicates that PT. Kareb Alam Sejahtera Bojonegoro is a company that tries to pay attention to the existence of people with disabilities to have the same job opportunities as other normal people.
